1. Acceptance of Terms

By accessing or using the SkyZero website (skyzero.io), the AirCharging mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Services.

SkyZero ("we," "our," or "us") reserves the right to update these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, by email notification. Continued use of the Services after changes constitutes acceptance of the revised Terms.

2. Description of Services

SkyZero provides electric aircraft flight tracking, charging infrastructure data, and aviation intelligence services. The Services include:

  • Real-time and historical electric aircraft flight tracking
  • Aviation charging station locations and status information
  • eVTOL and electric aviation market intelligence
  • Data analytics and reporting tools

3. User Accounts

3.1 Registration

Some features require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Deletion

You may delete your account at any time through your account settings or by contacting us. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

4. Subscription Plans and Payment

4.1 Free and Paid Tiers

The Services are offered on a freemium basis. Free access provides limited data, while paid subscription plans unlock additional features such as real-time charger status, extended historical data, and market intelligence.

4.2 Pricing

Current subscription plans and pricing are available on our Pricing page. Prices are stated in US dollars unless otherwise indicated. We reserve the right to change pricing with reasonable notice to existing subscribers.

4.3 Auto-Renewable Subscriptions

Paid subscriptions are auto-renewable. Your subscription will automatically renew at the end of each billing period (monthly or annual, depending on your plan) unless you cancel before the renewal date. You will be charged the applicable subscription fee at the beginning of each billing period.

4.4 Web Subscriptions (Stripe)

Subscriptions purchased through skyzero.io are processed by Stripe. You may manage or cancel your web subscription from your account dashboard. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date.

4.5 Apple App Store Subscriptions

Subscriptions purchased through the AirCharging iOS app are processed by Apple and subject to Apple's terms and conditions. Payment is charged to your Apple ID account at confirmation of purchase. To manage or cancel an App Store subscription, go to your device's Settings > Apple ID > Subscriptions. Apple manages all refunds for App Store purchases; please contact Apple Support for refund requests.

4.6 Google Play Subscriptions

Subscriptions purchased through the AirCharging Android app are processed by Google and subject to Google Play's terms and conditions. To manage or cancel a Google Play subscription, go to Google Play > Subscriptions. Google manages all refunds for Play Store purchases; please contact Google Play Support for refund requests.

4.7 Free Trials

If we offer a free trial, you will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Scrape, crawl, or use automated tools to extract data from the Services beyond what is provided through authorized APIs
  • Redistribute, resell, or sublicense the Services or data without written permission
  • Interfere with or disrupt the integrity or performance of the Services
  • Misrepresent your identity or affiliation

6. Intellectual Property

6.1 Our Content

The Services, including their design, features, analytics, and original content, are owned by SkyZero and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without written permission.

6.2 Public Data

Flight tracking data presented through the Services is derived from publicly available ADS-B transmissions, government aviation databases, and public aircraft registration records. Our value lies in the aggregation, processing, and presentation of this data.

7. Data Accuracy and Disclaimer

The information provided through the Services, including flight tracking data, charging station status, and market intelligence, is provided for informational purposes only.

  • No financial advice: Nothing in the Services constitutes financial advice, a recommendation to buy or sell any security, or a sufficient basis for making investment decisions.
  • Data limitations: Flight activity data may be incomplete, delayed, or subject to error. Charging station status is provided on a best-effort basis and may not reflect real-time conditions.
  • No warranty of accuracy: SkyZero makes no representations regarding the accuracy, completeness, or timeliness of the data and assumes no liability for decisions made using this information.

8. Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYZERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless SkyZero, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) will survive.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved in the courts of Ontario, Canada.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
